Conservation Commission Minutes - 08/15/2013

There was a motion to accept the minutes of the June 27th meeting.  The motion was seconded and accepted with a vote of 3-0-1; 3 Yes, 0 No, 1 Abstention.

There was a motion to accept the minutes of the July 18th meeting.  The motion was seconded and accepted with a vote of 3-0-1; 3 Yes, 0 No, 1 Abstention.

Ms. Michele Grenier’s Agent’s Report has been appended to the minutes.

GENERAL BUSINESS

Permit Decision:  Panther Way Sidewalks - CE159-1049
Mr. Mike Maglio, Town Engineer, and Mr. Jay Melo, Assistant Town Engineer, both appeared before the Commission for the issuance of the Orders of Conditions for this project.

There is a revised plan depicting the planting schedule submitted recently; i.e., the bio retention area which was requested by the Commission at the last meeting.

There was a motion to issue an Order of Conditions for the Panther Way Sidewalks approving the planting plan.  The motion was seconded and accepted with a vote of 5-0-0.




Minor Buffer Zone Activity:  680 Pleasant Street
Ms. Jessie Fanuele, homeowner, appeared before the Commission for the construction of a concrete patio.  She informed the Commission that it will constructed between her house and garage in the location of the existing patio and bulkhead area.

This area is riverfront and is already disturbed.  It needs to be filed as a Notice of Intent and not
a Minor Buffer Zone Activity filing so that Conservation has no control over the project with special conditions and an engineered plan that must be submitted with the NOI.

The question was raised by the Conservation Chair as if we are allowed to do a Minor Buffer Zone Activity for a project located in the riverfront area.

Ms. Grenier informed the Commission that she will look into this matter and contact the DEP to determine if a MBZA can be filed for a project within riverfront area.

Ms. Fanuele stated that she would like to withdraw this application without prejudice.  The Commission members stated that she is then required to file a NOI to be submitted for this project.


Public Hearing - Notice of Intent – Lot 14-1&aB Lena Circle – Marquerite - CE159-1051
Mr. Rob Truax, Engineer of GLM Engineering, and Dennis Marguerite, the applicant and property owner, both appeared before the Commission for the construction of a single-family house.

Mr. Truax provided the Commission members with background and a detailed overview of the plans for the site.  The majority of the site contains wetlands.

The house will be located outside the 50 ft. buffer zone and partially within the 100 ft. buffer zone.  The driveway will run through the 25 ft. buffer zone as it accesses into the site.  Roof runoff will discharge into leaching systems.  

Mr. Truax stated that they are requesting a variance from the bylaw to allow work to be conducted for the driveway within the 25 ft. buffer zone.  The area of disturbance is approximately 1800 sq ft.  This driveway is the only access to the site.

There are trees back in the area that will be cleared. A planting plan was requested.  All of the egress to be depicted on the plan was requested along with planting mitigation for the removal of the trees.  Use of the BDP Handbook was requested to be used in the planting plan.

Mr. Truax will submit the revised plans depicting the details which were requested by the Commission.

The Commission also requested that the stockpile area be depicted on the plans as far from the wetlands as possible.

There was a motion to continue the public hearing until September 5th.  The motion was seconded and accepted with a vote of 5-0-0.


Public Hearing - Notice of Intent – 5 Rona Lane – Hall - CE159-1050
Mr. Dana Clough, Engineer of Advanced Concepts Engineering, and Mr. & Mrs. Thomas Hall, the applicants, all appeared before the Commission for the replacement of stairway and landing with 12’x24’ deck to be enclosed as a three-season room.

Mr. Clough gave the Commission members a detailed background of the site as well as a detailed overview of the proposed plans for the project.  The deck will be located outside of the 25 ft. no disturb and between the 25 ft. & 50 ft. zone.

A siltation fence is proposed for erosion control purposes.  The Commission members stated that they prefer a 12” compost sock for erosion control and this needs to be revised on the plans.  A gutter placed in the downspout to collect water to eliminate the impact to the wetlands was discussed.  The Commission also requested that stone be placed under the deck and it was requested to extend this to the footprint of the drip line.  It was requested that a 4 ft. concrete paver for a pathway be put in to the concrete base of the steps.  What plantings are proposed for the project?   

The special conditions to be included in the OOC’s discussed were:

  • add a gutter with a downspout
  • a 12” sock
  • extend the stone to the drip line of the footprint
  • the walkway surface between the asphalt surface and the 4’x4’ concrete pad shall be 4’ in width
There was a motion to close the public hearing for 5 Rona Lane.  The motion was seconded and accepted with a vote of 5-0-0.

There was a motion to issue State and Local Orders of Conditions for 5 Rona Lane with the following 4 special conditions; there will be a gutter and downspout on the roof section of the project, erosion controls will be a 12” compost sock with biodegradable material, extend the stone underneath the structure just to the drip line, a 4 ft. wide walkway must be constructed to connect the asphalt to the 4’ x 4’ concrete pad at the base of steps.  The motion was seconded and accepted with a vote of 5-0-0.


Public Hearing - Notice of Intent – EMC Corporation – 55 Constitution Blvd. CE159-1052
Mr. Peter Bemis, Engineer of Engineering Design Consultants, appeared before the Commission for the construction of a recreation field at EMC Corporation.  

Mr. Bemis gave the Commission some background information of the site and a detailed overview of the plans for the project.  Mr. Bemis stated that there will be a small berm constructed around the boundary and hemlocks will be planted on top of it to provide screening for the abutters to the site.  Erosion control barriers will be installed along the property limit of work; there is a gravel driveway to allow access to the rear of the site.

Some arborvitaes were requested to be planted along the site.  The use of organic fertilizers was also suggested.  Also recommended was Dutch white clover cut in the turf to fix the nitrogen as well as tall fescue for grass seeds.

Mr. Bemis stated that waddles with silt fence are proposed for erosion control purposes.

There was a motion to close the public hearing for the EMC recreation field.  The motion was seconded and accepted with a vote of 5-0-0.

There was a motion to issue State and Local Orders of Conditions for EMC recreation field with 3 special conditions; non-phosphorus fertilizers must be used, change the hemlocks to giant arborvitae trees at the proper density for good coverage and the applicant may use a cut of Dutch white clover and tall fescue in the grass mix for lower maintenance.  The motion was seconded and accepted with a vote of 5-0-0.


Continued - Public Hearing - Notice of Intent – 19 Colt Road – Mali - CE159-1048
Ms. Charlotte Maliff, the homeowner, appeared before the Commission for the construction of a shed, walkway, retaining wall, and above-ground pool and associated deck.  Ms. Maliff submitted the revised engineered plan which was requested by the Commission at the last meeting.  Also submitted was the updated functions and characteristics statement.

The deck has already been constructed.  The loam still remains to be put down and then it will be seeded.  This is an after-the-fact Notice of Intent.  

Some measure of plantings may or may not include transplants from the property were plants from the list submitted on June 13th will be planted along the fence line.  The areas of disturbance will be loamed and seeded.  The lawn will be ready for a first mowing before the Certificate of Compliance is issued.  There will be no disposal or any debris nor any alteration of any kind in the future in Conservation jurisdiction.

There was a motion to close the public hearing for 19 Colt Road.  The motion was seconded and accepted with a vote of 5-0-0.

There was a motion to issue State and Local Orders of Conditions for 19 Colt Road subject to the 4 special conditions; there will be plantings along the back fence line, non-phosphorous fertilizers used on the lawn, no further dumping or alteration in Conservation jurisdiction, all of the disturbed areas must be loamed and seeded.  The motion was seconded and accepted with a vote of 5-0-0.


Minor Buffer Zone Activity:  2 Longobardi Drive
Mr. Wayne Carlson, representing Carlson Surveying, appeared before the Commission for the construction of a 12’x16’ deck. Mr. Carlson provided the Commission with some background information for the site.  The applicant has received a Certificate of Compliance for their home several years ago.

An erosion sock will be used for erosion control purposes.

There was a motion to issue a Negative Determination for 2 Longobardi Drive subject to the 3 standard conditions; that the applicant notifies the Conservation Agent before the work commences, that the work be conducted according to the plan and that the Conservation Agent be notified when the work has been completed.  The motion was seconded and accepted with a vote of 5-0-0.

Elections, Chair & Vice Chair
There was a motion to nominate Jeff Livingstone for Chairman.  The motion was seconded and accepted with a vote of 5-0-0.

There was a motion to nominate Monique Allen for Vice Chair.  She declined.  

There was a motion to nominate Marc DePoto for Vice Chair.  The motion was seconded and accepted with a vote of 5-0-0.
